<p dir="RTL">لا يمكن ان يكون هنالك جامع للمبادئ العامة للقانون لانها قابلة للخلق وللتطور النسبي بمرور الزمن, على الرغم من ان لها اهمية كبرى في جمال القانون الدولي عموما و القانون الدولي الخاص على وجه الخصوص, فالمبادئ العامة استمدت وجودها في البداية من النظام الاساس لمحكمة العدل الدولية الا انها بدات تتخذ ابعادا جديدة فيما بعد و تتعمق في معالجتها لاحوال في القانون الدولي الخاص لا مجال لان تكون محل تشريع او اتفاقية او حتى اتفاق لانها دائمة التطور و التجدد باعتبارها تعبر عن حيوية النظام القانوني وأداة من أدوات تنميته وتطويره، و عليه فلم يوجد اتفاق فقهي على تحديد المقصود منها, لذا فإن الخوض في دراسة المبادئ العامة للقانون يمكن ان يساعدنا في وضع ايدينا على أهم الآراء و أرجحها من بين ما قيل بشأن هذه المبادئ محل البحث.</p>
