<h3 dir="RTL">الجذور:</h3>
<p dir="RTL">تعود جذور التعليم الأهلي الحديث في العراق إلى سنة 1963، حين تأسست الكلية الجامعة بمبادرة من نقابة المعلمين، وفي سنة 1968 الغي اسم الكلية الجامعة ليحل محله اسم (الجامعة المستنصرية). وفي سنة 1974 صدر القرار المرقم (102) الخاص باعادة تنظيم الجامعات لتصبح الجامعة المستنصرية مؤسسة من مؤسسات التعليم الرسمي.</p>
<h3 dir="RTL">الواقع:</h3>
<p dir="RTL">لم يشهد التعليم الأهلي العالي في العراق اهتماماً كافياً إلا في سنة 1988، إذ تأسست بعض الكليات الأهلية حتى سقوط النظام السابق في نيسان 2003 (9) تسع كليات يتركز معظمها في بغداد، وبعض المحافظات كنينوى وديالى والأنبار والبصرة. وبعد التاسع من نيسان 2003 تأسست جامعات وكليات أهلية منها (جامعة أهل البيت) في كربلاء، والكلية الإسلامية الجامعة الأهلية في النجف، وكلية دجلة الجامعة الأهلية .. وقد اصدرت وزارة التعليم العالي والبحث العلمي أعلاناً في مطلع شباط 2005 قالت فيه ان الكليات الأهلية التي تأسست بموجب قانون الجامعات والكليات الأهلية رقم (13) المعدل معترف بها من قبل الوزارة وكذلك في جميع انحاء التعالم وان خريجي هذه الكليات يتمتعون بالحقوق والامتيازات نفسها التي يتمتع بها خريجو الكليات الرسمية في الجامعة العراقية، وان الكليات المعترف بها من قبل الوزارة حالياً (15) كلية وهي كلية التراث الجامعة الأهلية، وكلية المنصور الجامعة الأهلية، وكلية الرافدين الجامعة الأهلية وكلية المأمون الجامعة الأهلية، وكلية بغداد للعلوم الاقتصادية الأهلية الجامعة وكلية بغداد للصيدلة الأهلية وكلية الحدباء الجامعة الأهلية وكلية المعارف الجامعة الأهلية، وكلية اليرموك الجامعة الأهلية وجامعة أهل البيت (عليهم السلام) الأهلية في كربلاء، وكلية الدراسات الإنسانية الجامعة في النجف وكلية مدينة العلم الجامعة في الكاظمية المقدسة ببغداد.</p>
<p dir="RTL">في بحثنا هذا والذي نأمل في أن تكون له فائدة، سبق أن قدم كجهد علمي إلى وزارة التعليم العالي والبحث العلمي في 29 من آب سنة 2000 وبالتعاون مع الأستاذين الدكتورين مهدي فاضل العبيدي وجعفر محمد جواد الفضلي سيتناول فقط الكليات الوارد أسمها في المخطط رقم (1) وكما يلي:</p>

<h4 dir="RTL">الأقسام والتخصصات العلمية:</h4>
<p dir="RTL">وفي المرفق رقم (2) تفاصيل الأقسام التي تضمها هذه الكليات ومما يلحظ من المخطط أن هناك تبايناً في عدد الأقسام يتراوح بين (4-8) أقسام، فعلى سبيل المثال تضم كلية المنصور الجامعة (8) أقسام بينما نرى ان كلية المعارف الجامعة لاتضم سوى أربعة أقسام.</p>
<p dir="RTL">كما يتضح من المخطط ان اختصاصات العلوم المالية والإدارية والقانونية تكاد تكون القاسم المشترك بين الكليات الأهلية، حيث أن معظمها ضمت لادارة الأعمال والمحاسبة والقانون، هذا فضلاً عن اهتمام الكليات الأهلية بعلوم الحاسبات وهندسة البرامجيات وبحوث العمليات ويأتي هذا انسجاماً مع (الثورة المعلوماتية) التي ابتدأت منذ قرابة (10) سنوات.</p>
<p dir="RTL">وثمة ملاحظة أخرى وهي ان الكليات الأهلية لاتعطى العلوم الصرفة والطبية والصيدلانية والهندسية اهتماماً يذكر ويبدو ان ذلك يرجع إلى صعوبة استحداث مثل هذه الأقسام لما تتطلبه من مستلزمات مختبرية وبشرية وهذا لا يتوفر للكليات الأهلية في الوقت الحاضر.</p>

<p dir="RTL">من حيث التوزيع الجغرافي للكليات الأهلية نلاحظ ان أكثر من 50% من هذه الكليات تتركز في بغداد في حين ان حسن التوزيع يتطلب توزيعها على المحافظات وبخاصة تلك التي تفتقر إلى التعليم الجامعي، ولكن قوة الطلب على هذا النوع من التعليم في بغداد، وسهولة توفير مستلزماته، جعلته يتوجه هذا التوجه.</p>
<p dir="RTL">وفيما يتعلق بتطور اعداد الدراسين في الكليات الأهلية فيمكن القول بأن التعليم الأهلي في العراق شهد تطوراً ملحوظاً ليس من حيث عدد مؤسساته، وانما من حيث اقبال الطلبة للانخراط فيه، أو عدد الاقسام العلمية التي وصلت إلى (48) قسماً علمياً، كذلك شمول بعض الكليات الجامعة أقسام للدراسات المسائية وأدناه احصائية رقم(1) تبين عدد الطلاب الدارسين (الموجودين) في الكليات الأهلية موزعين حسب السنة والكلية ونسبة النمو السنوي للمدة 1988/1989 و 1998/1999 ويتضح من هذه الاحصائية ان هناك تباين في اعداد الطلبة المقبولين منذ عام 1988 ـ 1989. إذ كان عدد الطلبة المقبولين في الكليات الأهلية لا يتجاوز (1712) طالباً، لكن العدد أخذ بالازدياد فوصل خلال العالم الدراسي 1998 ـ 1999 إلى (19886) طالباً وطالبة.</p>
<p dir="RTL">وهناك احصائية أخرى تتعلق بتطور اعداد التدريسيين في الكليات الأهلية ففي العام 1988 ـ 1989 لم يكن عدد التدريسيين العاملين في الكليات الأهلية (ثلاث كليات فقط) يزيد عن (53) تدريسياً في حين وصل عددهم سنة 1998 ـ 1999 إلى (330) تدريسياً موزعا على تسع كليات وبنسبة نمو سنوية تصل إلى 819% ويدل هذا على ان الكلية الأهلية وفرت فرص عمل جديدة للتدريسيين من حملة الشهادات العليا وقد قلل هذا إلى حد ما حالات هدرة الكفاءات العلمية إلى خارج القطر.</p>

<p dir="RTL">لقد حصرت المادة (5) من قانون الجامعات والكليات الأهلية المرقم 13، حق طلب تأسيس جمعيات أو كليات أهلية في النقابات المهنية والجمعيات والمؤسسات الخاصة ذات النفع العام والمعروفة باهتمامها العلمي أو الثقافي أو التربوي، وأن يكون قد مضى على تأسيسها ما لا يقل عن خمس سنوات، كما أجازت تقديم طلب تأسيس جامعة لمجموعة من التدريسيين لا يقل عددهم عن (9) على أن يكونوا من حملة شهادة الدكتوراه وبمرتبة لا تقل عن أستاذ مساعد من المتخصصين والمهتمين بالشؤون التربوية والتعليم.</p>
<p dir="RTL">وثمة ملاحظة حول هذه المادة، وهي ان وضع بعض الجمعيات والنقابات المهنية المالية والإدارية يجعلها غير قادرة على الاطلاع بهذه المهمة وإذا ما تيسرت لها القدرة والرغبة في تأسيس تعليم أهلي، فان حافز الربح سيكون هو المحرك الأساسي لعملها... كما ان التدريسيين لا يمتلكون المال الكافي ومن هنا فانهم سيلجؤون إلى الأثرياء لتمويل إنشاء الكليات الأهلية وعندئذ سوف لا يكون هؤلاء الا واجهة أخرى للجهة صاحبة رأس المال.</p>
<p dir="RTL">وقد نصت المادة (28) من القانون على أن يوزع 10% من صافي الوفر السنوي للجامعة أو الكلية على الجهة المؤسسة، فهل يمكن أن تمثل هذه الـ (10%) ان وجدت حافزاً لاستثمار أموال كبيرة في قطاع التعليم العالي الأهلي؟ الجواب سيكون سلبياً الا إذا قدمنا تعليماً قليل الكلفة وبأجورعالية، وهو أمر لا ينسجم مع الأهداف التي رسمها القانون لهذا النوع من التعليم، ولا يتفق مع تطلعات المجتمع، وهذا يجعل وضع التعليم العالي الأهلي، في ظل هذا الواقع يعيش في مأزق حقيقي، فلا هو قادر على التطور للأهداف التي رسمها القانون، ولا الدولة والمجتمع راغبان في التخلي عنه، لأن له دوراً يمكن أن يكون فاعلاً في خدمة التطور العلمي للمجتمع.</p>
<p dir="RTL">لقد كان لشيوع نزعة السوق والبحث عن الربح أثر كبير في إباحة المجال للقطاع الخاص، وقد جاء ذلك انعطافاً للتوجهات الاقتصادية الجديدة التي بدأ العالم يشهدها منذ مطلع الثمانينات وأبرز ما في هذه التوجهات الدعوة إلى تقليل دور الدولة والعمل على اجتذاب الاستثمار الخاص. ولكن حقائق الواقع الآن تشير إلى إسهام القطاع الأهلي في الوطن العربي لم تصل إلا إلى 15% من مجمل نفقات التعليم العالي للبلدان التي توجد فيها مؤسسات أهلية عامة.</p>
<p dir="RTL">ولا تزال مسألة تمويل التعليم العالي الأهلي ونوع الرسوم الجامعية المستوفاة تشغل اهتمام القائمين على شؤون هذا النوع من التعليم، فضلاً عن الدولة والرأي العام. كما أن هنالك تبايناً بين الجامعات والكليات الجامعية الأهلية نفسها في مجال استيفاء الرسوم. ومن دون شك فان التطور الذي يشهده العالم الآن ومؤسسات التعليم العالي بشكل خاص يتطلب تمويلاً كبيراً لايمكن للدولة أن تتولاه بمفردها ولابد إذن من مشاركة مؤسسات المجتمع وشرائحه كما أنه من أجل بناء مؤسسات تعليمية وبحثية تقوم بدور مهم في نقل المجتمع ليواكب تطور العالم في القرن الحادي والعشرين.</p>
<p dir="RTL">وفي ما يتعلق بالكادر التدريسي الموجود في هذه الكليات وكما هو موضح في المرفقات (3-11)، يمكن القول ان معظم العاملين من التدريسيين في هذه الكليات هم من مرتبة (مدرس مساع، مدرس) وباستثناء كلية المأمون الجامعة التي تضم تدريسيين من مرتبة أستاذ يصل عددهم إلى (6) اساتذة ولاشك إن ذلك ينعكس على المستوى العلمي للطلبة في هذه الكليات.</p>
<p dir="RTL">لقد أثبتت تجربة الامتحانات المركزية واسهام طلبة الكليات الأهلية فيها أن هنالك ضعفاً شديداً في مستوى طلبتها العلمي لذلك أوصت ندوة مختصة بالتعليم العالي الأهلي في العراق والتي انعقدت ببغداد سنة 1988 بضرورة أن تقوم الكليات الأهلية، وطبقاً لما أفرزته تجربة الامتحانات المركزية من نتائج، بإعادة النظر في واقعها بشكل جدي وتقويم مسيرتها بشكل جدي بكل أمانة وجرأة انسجاماً مع ما هو مطلوب منها والإحصائية التالية تبين نسب النجاح التي حققتها الكليات الأهلية في الجامعات المركزية للعام الدراسي 97-1998.</p>

<p dir="RTL">لا تتوفر لدينا (في سنة 2000) معلومات دقيقة عن خطة استحداث، ومن خلال ما تمكنا من الحصول عليه يتضح انه هنالك مقترح لإنشاء كليتين اهليتين في بغداد هما:</p>

<li dir="RTL">كلية صيدلية أهلية وقد فتحت فيما بعد باسم (كلية بغداد للصيدلة) وعميدها الآن (2005) هو الأستاذ الدكتور فؤاد حسن.</li>
<li dir="RTL">كلية بغداد للفنون الجميلة، وتضم هذه الكلية ثلاثة تخصصات هي: الرسم، التصميم الخزفي (السيراميك)... وقد علمنا أن موافقة أولية من مجلس الوزراء قد حصلت لإنشاء هذه الكلية.</li>
</ol>
<p dir="RTL">أما على مستوى (الأقسام العلمية) فإن هنالك مقترحات لفتح أحدهما للعلوم النفسية والتربوية والآخر للقانون في كلية المأمون الجامعة، وفتح قسم للغة الانكليزية في كلية الحدباء الجامعة، وقسم للتاريخ في كلية المعارف الجامعة وقسم للقانون في كلية المنصور الجامعة ولانعرف مدى توفر الامكانات لانشاء مثل تلك الأقسام أو الكليات.</p>
<h4 dir="RTL">المستلزمات المادية والبشرية:</h4>
<p dir="RTL">تعاني معظم الكليات الأهلية من ضعف واضح في مستلزماتها المادية والبشرية. فعلى صعيد المستلزمات المادية نرى أن الكليات تفتقر إلى بنايات خاصة بها وإلى مكتبات متطورة كما ان الكادر التدريسي والوظيفي فيها محدود وفي مستويات متواضعة ويتطلب الأمر افساح المجال لمعالجة هذا الموضوع من خلال اعتماد مبدأ (الاعارة الداخلية) حيث نقترح أن توافق وزارة التعليم العالي والبحث العلمي على اعارة عدد من التدريسيين وخاصة من الذين يحملون مراتب علمية عالية إلى الكليات الأهلية لمدد تتراوح بين سنة وثلاث سنوات وبأجور ومكافئات مجزية.</p>
<h4 dir="RTL">أمور أخرى ومقترحات:</h4>
<p dir="RTL">لقد حددت المادة الثانية من قانون الجامعات والكليات الأهلية رقم 13 لسنة 1996 أهداف الجامعة أو الكلية الأهلية وذلك بـ (الأسهام في احداث تطويرات كمية ونوعية في الحركة العلمية والثقافية والتربوية والبحث العلمي بمختلف نواحي المعرفة النظرية والتطبيقية مستنيرة بالتراث العربي الإسلامي والتربية الوطنية والقومية الأصيلة، وتلتزم بالخط الوطني المستند إلى وحدة الشعب والوحدة بما ينمي جذوة الإيمان والابتعاد عن منهج الإلحاد). وقد القت هذه المادة مسؤولية كبيرة على الكليات الأهلية، ومعنى هذا أن الكليات الأهلية يمكن أن لا تكون رديفاً للكليات الرسمية وحسب وإنما تكون قدوة وحافزاً.</p>
<p dir="RTL">ان التصور المستقبلي الذي يمكن أن يقف عنده أي باحث في شؤون التعليم العالي لابد أن يأخذ بنظر الاعتبار، حقيقة بارزة صارت تفرض نفسها وهي أن الأذهان أصبحت مهيأة لقبول (دور واسع) يمكن أن يقوم به القطاع الخاص (الأهلي) في مضمار تطوير التعليم العالي، وليس بالضرورة أن يكون هذا القطاع منافساً للقطاع الرسمي في حركة التعليم العالي، وإنما لابد من ابراز (التعاون) و(التكامل) بين القطاعين في مجال ترصين العملية التعليمية والتربوية وتحقيق قفزة نوعية في أدائها والسعي باستمرار لتنشيط مفاصلها ومعالجة مشاكلها.</p>
<p dir="RTL">كما أن الاتجاهات الاقتصادية والسياسية الثقافية المعاصرة تلقي على عاتق التعليم الأهلي مسؤوليات واسعة في مجال عدم تكرار العيوب والنواقص التي يعاني منها التعليم العالي الرسمي، والبحث باستمرار عمّا هو جديد ومتطور سواء كان ذلك على صعيد المناهج الدراسية، أو الاستعداد لتلبية احتياجات المجتمع وسوق العمل.</p>
<p dir="RTL">إزاء ذلك، نقترح مايلي لتطوير مؤسسات التعليم العالي (الأهلي):</p>

<li dir="RTL">ينبغي أن يظل التعليم العالي الأهلي تحت اشراف الدولة ضماناً لتنمية المصالح الوطنية والقومية العليا، وحرصاً على المبدأ الرئيسي للتعليم العالي وهو انشاء جيل يؤمن بالله والوطن، ويسعى إلى تحقيق الأهداف السامية في الحرية والتقدم وبناء المجتمع المتطور.</li>
<li dir="RTL">في ضوء المقترح الأول نرى ضرورة أن تتكفل الدولة بتوفير بعض المستلزمات المادية للتعليم العالي الأهلي وخاصة ما يتعلق بالأبنية والأجهزة والمستلزمات الأخرى ولابأس من تقديم القروض والمنح التي تسددها الكليات الأهلية على أقساط وشمول المؤسسات التعليمية الأهلية بمبدأ الاعفاء الضريبي وما شابه.</li>
<li dir="RTL">شمول التدريسيين والعاملين في مؤسسات التعليم العالي الأهلي بالامتيازات والحقوق التي يتمتع بها التدريسيون والعاملون في مؤسسات التعليم العالي الرسمي.</li>
<li dir="RTL">اعتماد مبدأ الاعارة الداخلية للتدريسيين في التعليم العالي الرسمي للعمل في الكليات الأهلية ولمدة تتراوح بين سنة وثلاث سنوات.</li>
<li dir="RTL">دعوة الكليات الأهلية لفتح أقسام ليست موجودة في مؤسسات التعليم العالي الرسمي والابتعاد عن تكرار ماهو موجود في الكليات والجامعات الرسمية وفيما يتعلق بالمناهج والكتب الدراسية ينبغي أن لا يشترط التماثل بين الكليات الرسمية والكليات الأهلية في الكتب المنهجية، وقد يصار إلى تأليف لجان خاصة في الكليات الأهلية لإعداد كتب منهجية تلبي احتياجات أقسامها مع ضرورة المحافظة على مستوى رصين من التأليف.</li>
<li dir="RTL">لابد من استحداث (مجلس أساتذة) يكون بمثابة جهة رقابية على الجوانب العلمية والادارية والمالية لكل كلية ويتألف من عدد من التدريسيين من ذوي الخبرة والاختصاص من داخل وخارج الكلية ويتم اختيارهم من قبل مجلس العمداء فليس من المعقول أن يكون (مجلس الكلية) هو المخطط والمنفذ للعملية العلمية والتعليمية خاصة بعد الغاء مجالس الأمناء، ويمكن في هذا الصدد تشكيل مجلس يضم عمداء الكليات الأهلية ويكون مقره في بغداد باسم (مجلس العمداء) يتولى رسم السياسة العامة للكليات الأهلية ومراقبة تنفيذها والعمل على تطويرها على أن يجتمع مرة واحدة كل شهر.</li>
<li dir="RTL">نقترح انشاء نظام خاص للرواتب والحوافز لأعضاء الهيئة التدريسية في الكليات الأهلية يوفر لهم الاستقرار الأكاديمي والاقتصادي والاجتماعي ويحفزهم على القيام بالبحوث العلمية. كما يؤدي في الوقت ذاته إلى جذب الكفاءات العالية للعمل فيها.</li>
<li dir="RTL">الاستمرار في التعاون والتنسيق في مجال تبادل الخبرات العلمية والكمية في مؤسسات التعليم العالي (الرسمي) و(الأهلي) وادخال ممثل للتعليم العالي الأهلي في مجلس وزارة التعليم العالي والبحث العلمي لأغراض التنسيق والاطلاع.</li>
<li dir="RTL">تطالب الكليات الأهلية بإفساح المجال لها بفتح أقسام للدراسات العليا ووفق الشروط والضوابط المعمول بها في مؤسسات التعليم العالي الرسمي، الا أننا نرى وجوب التريث في هذا المجال ريثما تتوفر الامكانات والمستلزمات العلمية وعدم الاقتصار على تخصصات محدودة كالقانون والحاسبات والادارة. كما ان الضرورة تقتضي ولوج عصر المعلوماتية ونشر مفاهيمها النظرية والتطبيقية بين طلبة التعليم الأهلي وبما يتناسب مع حاجة المجتمع وتطلعاته المستقبلية.</li>

<p dir="RTL">تعود جذور التعليم الجامعي الأهلي الحديث في العراق إلى سنة 1963 حين تأسست الكلية الجامعة بمبادرة من نقابة المعلمين، وفي سنة 1968 ألغى الإسم ليصبح (الجامعة المستنصرية). وفي سنة 1947 صدر القرار المرقم (102) الخاص بإعادة تنظيم الجامعات وبموجبه أصبحت الجامعة المستنصرية مؤسسة من مؤسسات التعليم الرسمي.</p>
<p dir="RTL">ولم يشهد التعليم الجامعي العالي في العراق اهتماماً كافياً إلا في سنة 1988، إذ تأسست بعض الكليات الأهلية، وفي آب 1996 صدر قانون الجامعات الأهلية المرقم (13)، وقد أصدرت وزارة التعليم العالي والبحث العلمي قبل أيام قليلة إعلاناً في مطلع شباط 2005 قالت فيه أن الكليات الأهلية المعترف بها حالياً من قبل الوزارة ويتمتع خريجوها بالحقوق نفسها التي يتمتع بها خريجو الكليات الرسمية (15) كلية وهي:</p>

<p><span dir="RTL">في بحثنا هذا والذي سبق أن قدم كجهد علمي إلى وزارة التعليم العالي والبحث العلمي ولم يأخذ طريقه للنشر والمناقشة، وبالتعاون مع الأستاذ الدكتور مهدي فاضل العبيدي والأستاذ الدكتور جعفر محمد جواد الفضلي، يتناول تسع كليات توفرت عنها المعلومات والاحصاءات في 29 آب سنة 2000، ويقدم البحث مقترحات وتوصيات لتطوير التعليم العالي الأهلي في العراق بحيث لا يكون رديفا للتعليم الرسمي وحسب بل يكون قدوة وحافزاً، وأبرز هذه المقترحات العمل على فتح أقسام وتخصصات جديدة لا تتوفر في مؤسسات التعليم الرسمي وبخاصة في مجال ولوج عصر المعلوماتية ونشر مفاهيمها النظرية والتطبيقية بين طلبة التعليم الأهلي وبما يتناسب مع حاجة المجتمع وتطلعاته المستقبلية، هذا فضلا عن الدور الذي يمكن أن يقوم به هذا النمط التعليم في تحقيق الأهداف السامية في الحرية والتقدم وبناء المجتمع من جديد والمحافظة على ثوابته الوطنية والأخلاقية والإنسانية.</span></p>
